Terms of Service

1. Agreement
By clicking "Start free trial," entering a credit card, or otherwise accessing the InterviewCare service (the "Service"), you ("Customer") agree to these Terms of Service ("Terms") with InterviewCare, operated by Jay Isaacson ("we," "us," "our"). If you're agreeing on behalf of an entity, you represent that you have authority to bind that entity.
2. The Service
InterviewCare is a software service that conducts AI-driven video interviews with caregiver candidates and produces recordings, transcripts, and scored evaluations for hiring use. The Service is provided on a per-office subscription basis.
3. Free Trial
- The free trial lasts 7 days from the date you enter your credit card and select a plan.
- We will not charge your card during the 7-day trial.
- Fair-use limit during trial: up to 30 interviews.
- At the end of day 7, your selected plan begins and your card is charged. You may cancel anytime before then with no charge.
4. Subscription Plans & Billing
- Monthly — $299/month, no commitment, cancel anytime, billed monthly.
- 6-month — $249/month ($1,494 total), paid up front, 6-month commitment.
All plans include 30 completed interviews per month and a 12-minute-per-interview length cap. Each completed interview over 30 in a calendar month is billed at $5. Overage is charged at the end of the month it is incurred, regardless of the base plan's billing cycle.
Prices are in USD. Applicable taxes may be added. We may change pricing with 30 days' notice; changes take effect at your next renewal.
5. Cancellation & Refunds
- Monthly plan: cancel anytime; no partial refunds for the current month.
- 6-month plan: not refundable after the trial ends. You may pause your subscription in exceptional circumstances — contact us.
- Free trial: cancel anytime before day 7 and you're not charged.
6. Acceptable Use
You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, decompile, or scrape the Service; resell or sublicense the Service; use the Service to interview candidates for roles outside of caregiving and home-care staffing; upload malicious content; or circumvent usage caps.
7. Candidate Data & Consent
You are responsible for obtaining any consents required under applicable law from candidates before they take an interview. Our interview flow shows candidates a consent screen, but local laws vary — you remain responsible for compliance in your jurisdiction (including two-party-consent recording laws, background-check disclosures, and employment-related regulations).
You represent that you have the authority to share candidate contact info with us and to receive recordings, transcripts, and evaluations of those candidates.
8. Data & Privacy
Candidate recordings, transcripts, and evaluations are stored privately in your agency's dashboard. We do not sell candidate data, do not use candidate data to train third-party AI models, and do not share candidate data with other customers.
We use third-party processors (including a video-avatar provider, Anthropic or OpenAI for evaluation generation, Vercel for hosting, and Postgres/Blob for storage) under standard data-processing terms.
On termination, we will delete your data within 30 days upon written request.
9. Intellectual Property
InterviewCare, its software, question flows, evaluation logic, and branding are owned by us. You retain ownership of your candidates' data and any custom persona content you provide. You grant us a limited license to process your data solely to provide the Service.
10. Service Availability
We target high availability but make no uptime guarantees at these price points. Planned maintenance windows will be announced when possible. Third-party outages (e.g., our video-avatar provider, OpenAI/Anthropic) may affect interview delivery; we'll credit pro-rated service time if an outage lasts more than 24 hours.
11. Warranty Disclaimer
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated evaluations are a screening aid — not a hiring decision. You are responsible for all hiring decisions.
12. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability under these Terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits or hiring outcomes.
13. Indemnification
You agree to indemnify us against claims arising from your use of the Service in violation of these Terms, including any claim brought by a candidate relating to your employment or hiring practices.
14. Termination
You may cancel your subscription from your account or by contacting us. We may suspend or terminate the Service for non-payment, violation of these Terms, or if continuing the Service becomes commercially impractical. On termination, outstanding amounts remain due.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Los Angeles County, California.
16. Changes to These Terms
We may update these Terms. We'll notify active customers by email of material changes at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
